1. Acceptance
HW Core Enterprise is a sole proprietorship registered in Malaysia under registration number 202603191544 (KT0617984-D). By accessing or using our websites, VoiceNota app or related services, you confirm that you have read and agreed to these Terms and our Privacy Policy. If you do not agree, do not use the service. If you use the service for an organisation, you confirm that you have authority to bind it.
2. Eligibility
You must have legal capacity to enter into a contract. Anyone under 18 must have the consent and supervision of a parent or legal guardian, who is responsible for that use. You must provide accurate account information, protect your credentials and remain responsible for activity under your account.
3. Service scope and changes
VoiceNota provides speech-to-text, automatic categorisation, reminders and multi-space record management. We may modify, add, limit or discontinue features to improve security, reliability, legal compliance or commercial viability. Features, languages, device compatibility and third-party integrations may change.
4. Acceptable use
You must not use the service unlawfully; violate privacy or intellectual property rights; make unlawful or covert recordings; upload malicious content; impersonate another person; bypass limits; reverse engineer; perform automated bulk extraction; interfere with systems; or use the service for fraud, harassment or harm. We may investigate abuse and preserve relevant evidence.
5. User content and permissions
You retain rights in your content and grant us and necessary processors a limited, non-exclusive licence to process it only as needed to operate and provide the service. You confirm that you have the right to submit the content, have obtained any permission required for recordings or third-party data, and are responsible for legality, accuracy and backups.
6. Free and Pro plans
The free plan currently includes three AI voice records per day. Pro is planned to include up to 20 AI voice records per day and the full feature set. Manual text input does not count towards the voice quota. Pro payments and trials remain unavailable while Creem review is in progress.
7. Subscription, payment and renewal
Pro is priced at USD $2.99 per month, including tax and approximately RM12, subject to exchange-rate changes. No live payment is connected and no charge can be made while Creem review is in progress. Once payments officially open, the purchase flow will show the final amount, renewal period and applicable conditions before any charge.
8. Cancellation and refunds
This section applies only after payments officially open. You may cancel through the subscription-management link in your payment confirmation email or by contacting support. Cancellation stops the next renewal, and access continues until the paid period ends. Refunds will be handled under applicable law, the transaction circumstances and payment-provider rules. Contact us promptly about duplicate or unauthorised charges.
9. AI, transcription and reminder disclaimer
Automated transcripts, categories, amounts, dates and reminders may be wrong, delayed, incomplete or unavailable. You must verify them before saving or relying on them, especially for payments, tax, contracts, medical, legal, safety or business decisions. VoiceNota is not an accounting, legal, medical, tax or other professional adviser and does not guarantee reminder delivery.
10. Local data and backups
Content records are currently stored primarily on your device. Deleting the app, clearing data, device damage or loss, system updates or failed exports may cause permanent loss. You are responsible for maintaining appropriate backups. We do not guarantee recovery of local device data.
11. Third-party services
The service relies on OpenAI, Supabase, Creem, device operating systems and hosting providers. Third-party outages, policies, regional restrictions or feature changes may affect VoiceNota. We take reasonable care in selecting and managing providers but do not control their systems or warrant their independent acts beyond what applicable law requires.
12. Intellectual property
Except for user content, the VoiceNota software, brand, design, text and technology belong to us or our licensors. We grant you a limited, revocable and non-transferable licence solely to use the service lawfully. You may not copy, sell, rent or create a derivative service without written permission.
13. Suspension and termination
We may reasonably restrict or terminate service if you breach these Terms, fail to pay, create security or legal risk, abuse resources, or where required by law or a provider. Urgent security incidents may require immediate action. Payment obligations, liability limitations, intellectual property, indemnity and dispute provisions survive termination where applicable.
14. No warranties
To the fullest extent permitted by law, the service is provided “as is” and “as available”. We do not warrant uninterrupted, completely secure or error-free operation, fitness for a particular purpose or the accuracy of all output. Express or implied warranties that cannot lawfully be excluded remain unaffected.
15. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses involving profit, revenue, goodwill, opportunity or data. Our total aggregate liability arising from the service is limited to the fees you actually paid for VoiceNota during the three months before the event giving rise to the claim. This does not limit liability for fraud, wilful misconduct, death or personal injury, or consumer rights that cannot lawfully be excluded.
16. Indemnity
To the extent permitted by applicable law, you agree to be responsible for and indemnify us and our personnel against third-party claims, reasonable costs or losses arising from your unlawful use, unauthorised recordings or content, infringement of another person's rights, breach of these Terms or account misuse. We will provide reasonable notice and allow you to participate in the defence where our interests are not prejudiced.
17. Force majeure
We are not responsible, except where the law does not permit exclusion, for delay or failure caused by events outside our reasonable control, including network or cloud failures, third-party outages, natural disasters, government action, war, strikes, public health events or large-scale cyberattacks.
18. Changes to these Terms
We may update these Terms when our product, pricing, providers or legal requirements change. Material adverse changes will be reasonably notified through the website, app or account email. Continued use after the effective date means acceptance. If you disagree, stop using the service and cancel before the changes take effect.
19. Governing law and disputes
These Terms are governed by the laws of Malaysia. The parties should first attempt to resolve disputes in good faith through customer support. Unresolved disputes are subject to the jurisdiction of the competent courts of Malaysia. Rights to approach a consumer authority under applicable law remain unaffected.
20. General and contact
If part of these Terms is invalid, the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not transfer your account or this agreement without consent; we may transfer it as part of a lawful restructuring, sale or other permitted transaction.
